These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with the flocshop.com website (the “Service”) operated by Floc Shop (“us”, “we”, or “our”).
Please read these Terms and Conditions carefully before using the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
2.0 Purchases
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment methods (s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.
3.0 Availability, Errors and Inaccuracies
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
4.0 Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

The Service and its original content, features and functionality are and will remain the exclusive property of Floc Shop and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Floc Shop.
6.0 Links To Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by Floc Shop.
Floc Shop has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Floc Shop shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
7.0 Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Floc Shop its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
8.0 Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
9.0 Delivery and Returns
All orders are shipped from our studio in Bristol, UK.
9.1 Delivery
Delivery is charged at the rates set out in our shipping policy. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries. Prices in store and online may vary. We will notify you if your order is coming in separate packages or if there will be any delay in receiving any part of your order.
We will endeavour to pack and post your item within 1–2 working days of receipt of your order.
We will not be liable to you or to any third parties for any delay in an order reaching you where the delay is caused by our third party courier or for your failure to take delivery of the order. If the item is returned undelivered you will need to pay for the cost of re-delivery and we will not be able to refund original postage.
9.2 Damaged Delivery
We do our best to ship your order in a safe and secure way, but if your order for any reason arrives damaged, please let us know straight away (latest within 7 days of arrival) so we can help you solve the problem.
On most occasions we offer to send out replacements for damaged items, and in some cases additional compensation, but do not offer a full refund. If you do not want a new item shipped we kindly ask for you to initiate a return instead or make another arrangement with us.
Important: Please make sure to take photos of both the package and the damaged product and send it together with other relevant information about the claim to hello@flocshop.com. Remember to also state your order number in the email.
9.3 EU Shipping post 31 January 2020
Orders shipped to the EU may incur additional customs charges on arrival into your country. You are responsible for paying all the customs charges. We are unable to refund postage costs on items where customs charges are unpaid by you and the package is returned to us. Provided we receive the item back in saleable condition, we will refund the cost of the item less postage and any costs incurred by us when the item re-enters the UK.
9.4 Returns & Exchanges
We offer a 15 days refund upon receipt of the package, if you change your mind.
The items must be returned in their original condition and in the original, undamaged packing or similar protective tube/box. We reserve the right to refuse any returns that do not fulfil these criteria. Please note that you are responsible for the shipping back to us.
Important! Returns and exchanges happen at your own risk and own expense (shipping costs are to be paid by you). If any items arrive back to us damaged, we reserve the right to refuse any returns.
Please contact us at hello@flocshop.com before returning any items and remember to state your order number and relevant contact information in the email.
10.0 Out of Stock
All products shown are in stock unless otherwise stated. However, if for some reason an item should be out of stock anyway, you will be advised by email. If the item will be in stock again, you can choose to wait or cancel the order.
11.0 Colours
Due to the calibration differences between computer monitors, tablets and smartphones, etc. the colour on the poster shown on our website may vary slightly from the actual poster.
12.0 Privacy
At Floc Shop your personal contact information will be treated with confidentiality, and will not be shared with any third parties. For ordering handling purposes, however, we sometimes need to share your shipping details directly with the artist or our printing partner.
13.0 Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
